Connell Foley Sponsors a Seminar Presented by the Association of Corporate Counsel Delaware Valley (DELVACCA) Chapter
Partners Kevin R. Gardner,
William H. Graham,
John P. Lacey and
Tricia Bevelock O'Reilly will present at a seminar entitled, "Ethics: Attorney Client Privilege for the In-House Practitioner." The event, sponsored by the firm through DELVACCA, will address the creation, maintenance, challenges and protection of the attorney-client privilege for in-house counsel.
In-house practitioners are faced with many challenges when the interests of the individual employees and the corporation diverge or when the government requests the results from an internal investigation. Additionally, the Sarbanes-Oxley Act and recently proposed changes to the Federal Sentencing Guidelines present novel issues.
Questions to be addressed by this panel include:
-
How do you ensure your client understands the privilege?
-
How do you avoid inadvertent waivers of the privilege?
-
How do you minimize compelled disclosure of attorney-client communications during internal investigations?
-
Do companies that waive the privilege and turn over results of internal investigations to the government also waive the privilege for plaintiff lawyers?
-
Does cooperation with the government really mean waiver of the privilege?
The seminar takes place on Wednesday, March 8 from 8:00 a.m. until 11:00 a.m. at the Radnor Hotel in St. David's, PA. It will be moderated by Lisa Alexander, Deputy General Counsel, InterDigital Communications Corp.
