New Jersey Realtor Publishes Rhatican Article on Condemnation

The October 2007 edition of New Jersey Realtor offers James P. Rhatican’s analysis of a recent court decision on the practice of many local municipalities to condemn private property so that it can be redeveloped. In the article, Jay Rhatican provides some interesting insights into recent actions undertaken by various municipalities and associated judicial rulings relative to the Gallenthin decision. The author points to the recent Supreme Court ruling as a harbinger for a more conservative and limiting interpretation of what municipalities can and cannot do relative to taking property from private owners merely because they believe that the lands are not fully productive. Rhatican concludes by noting that if early interpretations of Gallenthin are any indication, the ruling will be making its mark on municipal redevelopment for years.
